By accessing, registering, or using Cotiza ('the Service'), you accept these Terms and Conditions in full. If you do not agree with any part, you should not use the Service. Cotiza is an AI-powered quote generation platform aimed at professionals in the construction, renovation, and related services sectors.

3. Service Description

Cotiza is a software-as-a-service (SaaS) tool that allows professionals to quickly create quotes using artificial intelligence. The Service includes:

• Automatic quote generation from job descriptions, photos, and voice notes
• AI processing for calculating materials, labor, and estimated prices
• Export to professional PDF with branding and logo customization
• Sending quotes via WhatsApp, email, and shareable link generation
• Client, product, catalog, and template management
• Quote history and status tracking

4. Trial Period

We offer a free 7-day trial period. To activate the trial, you must register a valid payment method (credit or debit card). During the trial, you will have access to Professional plan features. If you do not cancel before the trial period ends, your monthly subscription to the selected plan will automatically begin and the first charge will be processed.

We will notify you by email at least 7 days before your trial period ends to remind you that the subscription will begin automatically. You can cancel at any time before that date.

We offer a 20% discount on annual subscriptions. Prices shown include VAT where applicable under current legislation.

We reserve the right to modify prices with at least 30 days' notice. Changes will not affect already paid periods.

6. Payment and Billing

Payments are securely processed through Stripe. We accept credit and debit cards from major networks (Visa, Mastercard, American Express).

Billing is monthly or annual depending on the plan chosen. Payment is automatically charged at the beginning of each billing period.

Invoices are automatically generated and available in your dashboard. You will also receive them by email.

If you detect an error in any charge, you can dispute it by contacting us within 60 days. We will investigate and, if appropriate, process the corresponding refund within a maximum of 14 days.

7. Cancellation and Refunds

You can cancel your subscription at any time from your account settings. Cancellation will be effective at the end of the current billing period, and you will maintain access until that date.

We do not offer refunds for partial periods. If you cancel mid-month, you can continue using the service until the end of the paid period.

If you cancel during the trial period, no charges will be made.

Exceptionally, we may consider refunds in justified cases of serious service failures attributable to Cotiza. Contact support to have your case evaluated.

We will send you an email confirming the cancellation. Keep this email as proof of your request.

8. Right of Withdrawal (Consumers)

If you contract as a consumer (natural person acting for purposes outside your professional activity), you have the right to withdraw from this contract within 14 calendar days without giving any reason, in accordance with Article 102 of Royal Legislative Decree 1/2007 (LGDCU).

In the case of Cotiza, the service is considered to have started when you access the platform and begin using its features (creating quotes, managing clients, etc.). By registering and accepting these terms, you expressly consent to the immediate commencement of the service.

To exercise the right of withdrawal before the service begins, send a clear communication to soporte@cotizapro.es.

If you are acting as a professional or business (self-employed with business activity, commercial company, etc.), the right of withdrawal does not apply to you, and the relationship is governed by the Commercial Code and applicable commercial regulations.

9. Registration and Account

To use Cotiza, you need to create an account providing accurate and up-to-date information. You must be at least 18 years old or have legal capacity to contract. You are responsible for maintaining the confidentiality of your password and for all activities carried out with your account. You must notify us immediately if you detect unauthorized use. One person or company may only have one free or trial account.

11. Use of Artificial Intelligence

Cotiza uses third-party artificial intelligence systems (Anthropic) to analyze descriptions and automatically generate quotes. Although we strive to provide accurate and useful calculations, generated quotes are indicative estimates based on the information provided.

AI may generate unexpected, incomplete, or incorrect results. You should always apply your professional judgment.

12. Intellectual Property

Cotiza, including its source code, design, brand, logos, text, and artificial intelligence, are the property of José Oscar Sánchez González or its licensors. All rights reserved.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service according to these terms solely for your professional purposes.

The quotes you generate, your business data, and your clients' information are your property. Cotiza does not claim any rights over your content.

If you provide us with suggestions, ideas, or feedback, you authorize us to use them without compensation to improve the Service.

13. Your Data and Privacy

You own the data you enter into Cotiza (client information, prices, catalogs, quotes). You retain all rights to your content.

You can export your data at any time from your account settings in standard formats (CSV, JSON, PDF).

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these terms. Privacy Policy.

As an EU user, you have rights under GDPR including access, rectification, erasure, and portability of your data.

14. Third-Party Data

If you enter your clients' data into Cotiza, you represent that you have a legal basis to process that data (consent, contractual relationship, etc.) and that you comply with data protection regulations.

You are the data controller for your clients' data. Cotiza acts as a data processor as defined in our Data Processing Agreement (DPA).

If you need a signed DPA to comply with your legal obligations, you may request one.

15. Service Availability

We strive to keep Cotiza available with a target monthly uptime of 99.5%. However, we do not guarantee uninterrupted operation.

Planned interruptions may occur for maintenance, updates, or improvements. We will try to notify you in advance and perform them during low-usage hours.

We will not be responsible for interruptions caused by circumstances beyond our reasonable control (force majeure, third-party failures, cyber attacks, etc.).

16. Limitation of Liability

Cotiza is provided 'as is' and 'as available'. To the maximum extent permitted by Spanish and European law:

We will not be liable for: indirect, incidental, special, or consequential damages; loss of profits, data, business opportunities, or goodwill; incorrect quotes that you sent to your clients without verification.

Our total cumulative liability for any claim shall not exceed the amount you have paid for the Service in the 12 months preceding the event giving rise to the claim.

Nothing in these terms limits your rights as a consumer under Spanish consumer protection legislation, if applicable to you.

17. Indemnification

You agree to indemnify and hold Cotiza, its owner, and collaborators harmless from any claim, demand, damage, cost, or expense (including reasonable legal fees) arising from: your breach of these terms; your misuse of the Service; incorrect or misleading quotes you sent to third parties; your infringement of third-party rights or applicable legislation.

18. Termination

You can cancel your account at any time from the settings. After cancellation, you will have 30 days to export your data before it is permanently deleted.

We reserve the right to suspend or cancel accounts that violate these terms, abuse the Service, or fail to pay corresponding fees. We will notify you of suspension except in cases of serious breach.

After termination, you will lose access to the Service. Clauses that by their nature should survive (intellectual property, limitation of liability, applicable law) will remain in effect.

19. Modifications to Terms

We may modify these terms occasionally. We will notify you of substantial changes at least 30 days in advance by email or through a prominent notice in the application. Continued use of the Service after the modifications take effect implies your acceptance. If you disagree, you must cancel your account before the effective date.

20. Communications

You agree to receive service-related communications (invoices, security alerts, terms changes) by electronic means to the email associated with your account. These service communications are not marketing and are necessary for Service provision.

21. Severability

If any clause of these terms is declared null or unenforceable, the remaining clauses will remain in full force and effect. The affected clause will be interpreted or modified to the minimum extent necessary to make it valid and enforceable.

22. Waiver

The failure of Cotiza to exercise or enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

23. Entire Agreement

These terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Cotiza regarding the use of the Service, and supersede any prior agreement, verbal or written.

24. Applicable Law and Jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute arising from these terms or use of the Service, both parties submit to the Courts and Tribunals of the city of Madrid, Spain, expressly waiving any other jurisdiction that may apply.
